This offense applies to someone who is under 21 but at least 18 years old. It is not a Criminal offense but it is still important to hire an experienced attorney to ensure you are getting the best result possible. The person charged must take a chemical test at the request of law enforcement, who believes they are driving under the influence, and the results of that test must be between .02-.08 blood alcohol content.
Penalties for a first offense are:
- A 1 to 3 month loss of license
- 30 hours of community service
- Fine of not more than $250
- Attendance at a driving course and/or alcohol treatment

- A 3 to 6 month loss of license
- 60 hours of community service
- Fine of not more than $250
