Driving While Impaired

This offense applies to someone who is under 21 but at least 18 years old. It is not a Criminal offense but it is still important to hire an experienced attorney to ensure you are getting the best result possible.  The person charged must take a chemical test at the request of law enforcement, who believes they are driving under the influence, and the results of that test must be between .02-.08 blood alcohol content.

                Penalties for a first offense are:

  • A 1 to 3 month loss of license
  • 30 hours of community service
  • Fine of not more than $250
  • Attendance at a driving course and/or alcohol treatment

Penalties for a second offense are:

  • A 3 to 6 month loss of license
  • 60 hours of community service
  • Fine of not more than $250
  • Attendance at a driving course and/or alcohol treatment
  • $300 highway assessment fee
