What Is Considered Defective?
If a product is working differently than advertised, has caused someone harm, or has a high chance of causing injury, it may be defective.
Common products that may be defective include:
- Medical equipment
- Children’s toys
- Food (resulting in food poisoning)
- Kitchen appliances
- Yardwork equipment
If you have been hurt by a defective product, check the box and manuals for any warning labels. Some things come with obvious hazards that are identified through warnings, but may still be defective or too dangerous in nature. It is always manufacturer’s job to include a label warning consumers of the danger and to provide safe, thoroughly tested products.
Who Is Responsible?
Products often change a lot of hands before they make their way into your household. Manufacturers usually go through wholesalers to sell their products, and those sellers then distribute the product to various retailers. When something goes wrong, which party is to blame?
In many cases, the answer is all of them. Whoever is selling a product is giving you their guarantee that the item works as advertised. When you are building a product liability suit you could include each of the distributors as a responsible party. While not every case involves multiple parties, our firm carefully investigates to ensure every potentially liable party is held accountable for their actions.
